High Court grants interim non-disclosure order restraining publication of hedge fund information

  • The High Court granted an interim non-disclosure order restraining a news agency from publishing confidential hedge fund information in March 2017.
  • The conflict arose between the maintenance of confidentiality and the public interest in the publication. Public interest in the matter saw that due to the economic effect of the hedge funds and also the public interest in the identity of the investors in the claimant's funds, the availability of this information would allow individuals to influence and hold to account institutions whose investment decisions affected their financial welfare.
  • However, this argument was outweighed by the need for the protection of confidentiality, with this need all the stronger when the investments were worth tens of millions of dollars.
